A US employer filed for my H1 transfer after my return. I got the approval today but it says: The Vermont Service Center has approved the following I-129 Petition for Nonimmigrant Worker that had been filed under the Premium Processing Service: Receipt Number: XXXXXXXX Petitioner: XXXXXXXX Beneficiary: XXXXXXX DOB: XXXXXXXX Classification: H1B Starting Validity Date: 01/22/14 Ending Validity Date: 01/12/17 Consulate notified (if applicable): NEW DELHI I-94 # (if applicable): The form I-797 Approval Notice will follow in the mail. Does that mean that I have to go for stamping to work for the new employer? Link to comment

pontevecchio Posted January 22, 2014 Report Share Posted January 22, 2014 Since you are out of the country the word "transfer" does not apply. In the case of a transfer a previously valid H1 visa can be used when you change jobs. In your case ask the new company what their Lawyer says. Ideally get a H1 visa for the new employer under your circumstances. Link to comment

This is what my attorney said: You do not have to return to New Delhi for stamping because your H1B visa is valid to September 30, 2014. You may now enter the USA using that visa and the new approval. We will scan that to you as soon as it arrives – probably early next week. Please let us know when you will travel to the USA to begin work. I am confused. Not sure if I should travel using previous employer's stamp or not. Link to comment

ambi_girl Posted January 28, 2014 Author Report Share Posted January 28, 2014 @jobseeker1 - My attorney suggested me to travel with old visa and new I-797. So I'll not appear for stamping again. I checked few immigration faqs on other sites and they all say that it is perfectly ok to travel like thi. Link to comment
