H1B - Out of Status

Hi,

 

My last day of employment with my current company was last week. I found another employer who filed LCA and willing to apply for my H1 transfer. The gap between my last day of employment and the H1 transfer petition is about 10 days.

 

Questions are:

 

I know right now am out of status. Can I start working as soon as I get the H Receipt from the USCIS. The company will file my H Pet in PP.

Is that legal to start working with the receipt?

 

My H1 and I 94 is valid till end of next year. Also I have current H1 stamped in my passport.

You are well advised to wait for the result of the H1 petition application first. In any case talk to the HR/Lawyer about the matter.
