Since this was my first crime ever, I was given diversion and a probabtion period of one year which will end in june 2014. I have joined a company as a full time employee who has sponsored my H1b transfer. I have joined the company based on h1b receipt, but approval is pending yet. Since I was diverted, I didn't declared any convictions for any misdemeanor. I am just worried, if USCIS can cancel my H1b on this ground. Please advice if I can do anything. If not please do so now. yes pls talk to your lawyer. your lawyer will brief you what to say ( and what not to say ). as posted previously, this is NOT oprah. do not ramble on and on and be emotional. also have your lawyer's contact info if they need to follow up with your lawyer who will speak on your behalf. be confident that your lawyer is the best and will guide you. coming to the net is great for support but you need your lawyer's guidance. everything will work out but you need your lawyer !
