EAD-stop working

My GC is pending with Priority date 2006(eb3). Currently me and my husband on EAD(valid till march 2015). I am the primary applicant.

recently my husband's company started his GC, applied for labor in Nov.2013(eb2).

my concerns are

1) if i stop working now, am i going to be out of status??

2) is that going to effect the status of my family until my husband's i-140 approved???

or do i need to wait until my husband I-140 approved to quit my job???

any help will be appreciated....

Assuming both have pending AOS on file,

 

1. No. They may of course ask for an EVL at any time or not.

2. Both are awaiting AOS  legally.

 

Your GC petition is predicated on working for the sponsor or using AC21 any other employer in roughly the same field. If your GC sponsor as of now will provide proof where needed that your job is waiting for you on getting the GC you are fine. Keep a Lawyer on board till the GC arrives.
