cbhanu_11 Posted January 5, 2014 Report Share Posted January 5, 2014 Hi There, I have a H1B US VISA (Got stamped in India) and it is going to end on March 2014 and I have already traveled once to US for 2 months and with health problem I came back. At present I am in Germany, Frankfurt on Work Permit. First of all I would like to know whether my VISA is still valid and Also I would like to go for extension of my H1B VISA. Employer files a cap exempt petition and on approval with a valid H1B visa and new I797 you can enter US to work for employer. You still have 5 years and 10 months i.e. max years of 6 years allowed on h1B - 2 months spent on H1B. Link to comment

pontevecchio Posted January 6, 2014 Report Share Posted January 6, 2014 The visa is an entry document and useless by itself. Based on being capped once you are entitled to a total of 5.8 more years in H1 status in total. Any interested company can file and get your H1 petition approved non cap and then you can come over to start work. Link to comment
JoeF Posted January 6, 2014 Report Share Posted January 6, 2014 The H1 is only valid if you have a job in the US with the company that filed the H1. And an H1 can only be extended if you have a job in the US. The company would have to file an extension. Link to comment
