Emergency Travel while H4 extension nder process -- PLEASE HELP

My husband is on H1B and I am on H4. Both of our visas expired on April 25, 2011. Extension for H1B (Premium Processing) and H4 extension filed together with a USCIS Receipt date of April 19th, 2011.

Applications still pending as there is a minor RFE which the employer is handling.

I need to travel to India on emergency due to the passing away of my dad and my mother is very ill in the hospital.

PLEASE can anyone let me know if I can travel to India and then apply for H4 in India without issues? Will I be considered out of status since April 25, 2011 if I leave the country? Greatly appreciate any info as soon as possible.

I would go for stamping to the Mumbai Consulate. Thank you all.

YES. You can. Once your spouse gets the H1 extension you can come back on the H4 visa.
