H1 Transfer and take week off

Hello Friends,

After serving 2 weeks notice, I am planning to take approx. week of between my transfer. I will be visiting my home country. I guess I can legally do this although I am not on payroll as I wont be in USA. Please confirm.

While coming back can I use my previous employers visa stamp and new employers 797 to enter USA. Please let me know.

Yes, as you are outside US it does not have any effect. You can return with old employers valid H1B visa and new I797.
