H1B was approved, never stamped. An year later am I cap exempt?

Hi,

 

I got my H1B approved in 2012, I worked with my employer till Dec 2012 and then quit my job. My visa was never stamped and my employer told me that they would withdraw my peitition once I quit. I moved back to India to take care of my terminally ill mother.

Now an year later, I am wondering if I am still H1B cap exempt. I am planning to move back to the US and  might be able to get a job offer. Things will be lot easier if I am H1B cap exempt.

 

Would be grateful for any help.
