Based on the facts, an H1b (husband) can be applied with the old cap, so how about H4 for myself and my son. additional details: a.My husband had an approved H1b (nov 2006). Left for US in Jan 2007. Again left US in April 2010 relocating to singapore and KL( 2013) respectively. b.I previously held an H4 and it expired in sep 2010. c.Our son was born in singapore (sep 2010) queries : 1.Can a H4 be filed together while an H1b is also being filed? 2.If so what are the documents to be included and what extra/supporting documents need to be provided too? 3.What would be the approximate processing time? 4. My previous H4 was in my old passport , so do I need to furbish the old details while applying for the new H4? 5. What are the needed documents to file H4 for my son aged 3? Thanks You need to apply for a H4 visa for you and your son at an US consulate. The visa interview could be scheduled together with your husband's H1B visa interview. You would need a copy of your husband's I797 approval notice. It would be better to have a copy of his H1B documents too. If your visa is approved you will get your passport back in 2 to 3 days. See 1. 3.See 1. 4. See 1. 5. The same as for you. It may not be necessary for him to come physically to the consulate. Please do read up the procedure on the relevant consulate website.
