GC is for future employment. That means you will be working for that employer in future, so it doesn't matter what's your current status is.

  • what i am trying to ask u was with my current employer i will be working in india but he wont support gc....
  • the US employer only will be supporting GC will this possible...

If your current employer is in India then obviously he can't file your GC bcos only US employer can file GC. So in your case, you are good to go.

@all:

  • thanks for your reply...
  • it would be great if you let me know what documents should my employer need to show to US government to support my GC..
  • since he is new he doesnt know much about it...
  • it would be great if you provide me the details...

Does your employer hired an attorney?? If not tell him to hire one and he will take care of your GC process.

He should take advice from an attorney. The fact you are doing the research is a BIG flag that this employer leaves a lot to be desired and you need one that is better established and likely to be around for a while. A responsible employer would have already engaged an immigration attorney to advise him..
