GC is for future employment. That means you will be working for that employer in future, so it doesn't matter what's your current status is. Link to comment

If your current employer is in India then obviously he can't file your GC bcos only US employer can file GC. So in your case, you are good to go. Link to comment

The fact you are doing the research is a BIG flag that this employer leaves a lot to be desired and you need one that is better established and likely to be around for a while. A responsible employer would have already engaged an immigration attorney to advise him.. Link to comment
