Can one apply for H-1 while the J-1 waiver application is still under processing?

Is J-1 waiver required while applying for H-1, or only while stamping the new H-1 visa?

If you look at some posts in this forum people have obtained H1B visa when their J1 waiver is under process.

Without getting the waiver you are not eligible to change status TO h1.

If you were subjected to HRR. To file your H1, your employer needs J1 waiver approval letter or atleat a letter from DOS or USCIS stating your application is under review.

Having said this I am not sure about the validity of those H1Bs.
