This is the waiting period till I get my labor approval within 1 to 3 months? And then can I convert my status from h4 to h1? Any help appreciated.

Once the principal applicant (your wife) is outside the country beyond a certain duration your H4 status ceases to exit. You need to exit US.
pontevecchio Posted October 28, 2013 Report Posted October 28, 2013 Why would you want to do something which will always be on record? Leave and once the H1 extension is possible come back in H1 status.
