ashishk1 Posted October 21, 2013 Report Posted October 21, 2013 Need experts advice: Scenario: I and my spouse got GC on 30th Sep. I'm primary and my spouse got it as dependent. Due to personal reasons, I'll not be able to continue in US for another 2-3 years and it will result in abandonment of my GC. However, my spouse will maintain her GC and will qualify for citizenship after 5 years. Questions: 1. Can my spouse sponser me after she gets her citizenship? 2. Is there any special requirement after GC abandonment?
pontevecchio Posted October 22, 2013 Report Posted October 22, 2013 You do not say how she will be supporting herself. You have also not considered the use of a Re-entry Permit. I suggest you schedule a consult with a Law firm , maybe Murthy to go over the matter to avoid coming to a bad decision.

She will working in US and re entry permit helps for a year or so but not more than 2 years. I'll be coming to US but it won't be for more than a month per year for next 2-3 years.
pontevecchio Posted October 23, 2013 Report Posted October 23, 2013 Get a Lawyer to help you with the specifics. She can sponsor you in future after becoming a Citizen.
t75 Posted October 23, 2013 Report Posted October 23, 2013 Are you being assigned to work abroad by a US company or are you just choosing to do so? (It is kind of hard to believe you would choose to abandon your spouse for so long.)
cap-gap Posted October 23, 2013 Report Posted October 23, 2013 It is kind of hard to believe you would choose to abandon your spouse for so long. exactly, the possibility of sponsorship exists....but for this type of cases, unlike EB spouses, the burden to prove the validity of marriage is very high and petition comes under lot of scruitiny..
ashishk1 Posted October 23, 2013 Author Report Posted October 23, 2013 Thanks all. I'll set up a meeting with lawyer
