I just learned that my employer did not respond to RFE on my EB2 (porting from EB3) case. He said that he will refile in premioum processing once he gets the denial notice. I don't expect any udapte on the USCIS website during the goverment shutdown. Should i go for VIsa stamping during this perioid ? How badly not responding RFE can affect my EB2 porting case as well my employer? Link to comment

Thanks for your reply ! I got my H1 extension till 2016 .. My Question is about visa stamping while my case of i140 in EB2 category got RFE and my employer did not respond it at all. pontevecchio Posted October 14, 2013 Report Share Posted October 14, 2013 The visa stamping is separate from any RFE for your I-140 and should not affect your stamping. There are many reasons for delay. This should not be one reason. Link to comment
