H4-Extension is pending and plan to travel to India

Hello Friends,

 

Here is the situation,

- H4 extension is pending,

- I94 and visa has expired,

Now want to travel to India which means abandoning extension am I correct?

 

In order to enter again, of course H4 dependent has to go for stamping. But will there be any issue? as H4 dependent is staying in USA beyond I94 validity but on extension pending papers.

 

Also what is the document that will state - this particular dependent was lawfully present in USA?

Nothing to worry. When you go for H4 visa interview carry your EOS receipt notice.

The pending status extension will show up on the consulate Officers screen during the H4 visa interview.
