Singhh Posted September 22, 2013 Report Posted September 22, 2013 Hi All, I have been sentenced to 3 yrs probation for DWI`s in NY. I have completed 2 years successfully and completed every thing like Drunk Drivers Course, AA course and up to date paying fees. I want to know if a probation officer( or probation office ) can change my remaining 1 year probation period into community service and let me go soon? do PO has that power ? Please let me know is it possible at all ? I was not put in to community service while i was sentenced. no jail time. I am going through hard time to get a job now a days...that is y i am looking all the possibilities. Please help me.
pontevecchio Posted September 23, 2013 Report Posted September 23, 2013 It would be in your best interests to talk to a DUI Lawyer in NY and discuss possibilities including Expungement to the maximal extent possible once the probation is deemed over.
Singhh Posted September 23, 2013 Author Report Posted September 23, 2013 Thanks pontevecchio, That would be my next stop. But I am not sure if the PO has the ability to convert it or not. As far as I assume, Only court can change the probation period and PO must support it. Please throw some light on it.
pontevecchio Posted September 23, 2013 Report Posted September 23, 2013 Firstly the law of NY should allow this. Hence a Lawyer. The decision will then be by a Judge who may look at your probation record and Officers take. Did you not involve a DUI Lawyer when this happened?
