Now she is staying in USA with a status of GC(IR1 category). If I want to get a divorce, should we apply in India or we can apply in USA? If we apply here is it is valid in India? The divorce is not mutual. I want to take the divorce. So can anybody tell the solution for this issue? How much time will it take to complete the process? Thanks, Krishna. Link to comment

cap-gap Posted September 20, 2013 Report Share Posted September 20, 2013 your divorce here is valid as long as it is not going to be challenged, however, as you can see, a non mututal divorce can be easily challenged...a disgruntled ex-wife can easily create problems for you with some 408 case or something like that.. cap-gap Posted October 17, 2013 Report Share Posted October 17, 2013 Can you explain your statement? after a non-mutual divorce here, an indian spouse can go to india and challenge the divorce there and also possibly open those 498a cases against ex-spouse and inlaws. in that case, the court will issue summons, warrants etc. but those are effective only in india and if the accused visits india..
