How long is H1 B issued in Quota valid

Hello,

 

Need your help! Given below is the scenario. please help

 

 

2004 - H1 B petetion issued with employer A (India based leading IT firm)

2004 - H1 B Stamped with Employer A

2005 May - Travelled to USA A

2007 - H1 B petetion extented with employer A

2007 - Nov - H1 B petetion transferred employer B (US based MNC) while in USA

2008 - Mar - Relocated to India (after 2 years 10months)

2009 - H1 B petetion transfered to empoyer C and stampped

2009 Apr - Jun - travelled to US for short trip and came back to India

 

Did not go back to US after 2009 Jun ; Currently I am with company D and planning to change job to company E and go to USA.

 

- Can my old petetion transferrable? or should i need to go through new quota??  What is the easy way to get in to USA in this situation????

 

Can i get a tourist /business VISA to USA and go there >> get this Petetion transferred to any employee... is this an option? what are the consequences?

First find a H1 sponsor. You MAY be entitled to about 3 years non cap. One is allowed to come in and give Interviews on a tourist visa. But you need to leave and enter with a H1 visa . Why not see if the US Company is interested?

You would be cap exempted. If you have an employer ready to file H1B then ask them to check the appropriate options on the I129 filing
