My Status change ineligible.When should I apply for valid visa? and how soon I can expect to start my employment

Dear Gurus, 

 

I was on OPT 17 month extension and had a validity till July 2013,also I had applied for H1 B for status change from F1 to H1-B,but due to personal reason I have to leave the country in April 2013,but my visa was not approved.But in June my employer got the letter of approval  I-797 B but in that it says that I am ineligible for change of status as I have left the country but can but may apply for proper visa at consulate abroad in India.

So my question is what is the validity to apply for this visa and even if the visa is approved how soon I have to enter in United states with approved Visa status also in that case will validity reduce like I have 3 years of visa .Will it reduce by 3 months if I go in December.

The visa will be for 3 years. The I94 you get on coming over up to 10 days before the H1 job starts will be till the expiry of your H1 petition..

dude I have same situation. I was in India when my h1 b got approved. I also have to leave country before October and come back to work as h1. Any Idea which kind of question VO may ask to us(First time h1 stamping \h1 stamping before h1 start date)?
