Secondment while on H1B

Hello, 

 

I am in my fourth year of H1B and a month ago traveled to India on family medical leave. Now I want to work for a while from India for my US company. I am told by my company that I can work remotely for up to 4 weeks after which I might have to transfer to my local office here in India on a secondment to continue working during my time in India.

 

My understanding was that I can work up to 180 days in India while on H1B status without having to transfer or any legal issues. Can someone throw some light into this?

 

I also wanted to know how this would affect my H1B status/return to USA at port of entry.

Your work in India has no connection to your H1 status. In fact you can claim those 6 months as additional H1 time in future.

H1 is your status in US not in your home country. In your home country you are the citizen.
