nazeem.khan Posted August 22, 2013 Report Posted August 22, 2013 Hello, I am in need of your inputs on my case. I have applied for my wife's H1B this year and she got selected from the lottery. Last month, we got the RFE for her case and in the RFE they requested my valid H1B status. Whereas, my H1B extension is pending (filed in June 2013) and it done as non-priority basis. When I spoke to my attorney about my H1-B status and expediting it, he suggested that sending my H1B receipt notice to USCIS as reply for the RFE would be enough. Whereas, my wife's attorney suggested to expedite my H1B extension case, to get the approval and send that as part of the RFE response for my wife's H1B. I am too clear on how to proceed with this type of case. I am not too sure, whether I need to expedite my case or not? Please guide me. Nazim
jairichi Posted August 23, 2013 Report Posted August 23, 2013 Both are good options. How important is your wife's H1B to both of you? Best would be to do premium processing of your extension (you could pay), get approval and send a copy of it to reply your wife's RFE.
