L2 EAD & GC

Thank you in advance for your patience & time to read through all the details of my situation.

 

Here are my details:

I am currently on L2 EAD & my wife in on L1.

Our Visas were valid through May ’13. When we came to USA in Jan ’13 we got our I-94s till our respective Passport validity dates. L1 1-94 till Nov ’15 and L2 I-94 till Apr ’14.

Based on the new I-94 I currently have a valid EAD till Mar ’15. I also got my Passport renewed in Jun ’13.

 

Now here are my questions

1.    Can I start my GC processing?

2.    Can I apply for H1B in Oct ’14?

3.    Can I get my I-94 extension based on my wife’s I-94?

4.    If I apply for a GC how long would it take?

1. Usually a GC sponsor is needed.

 

2. You can apply THROUGH a H1 sponsor after April,1 next year for a potential start date in October.

 

3. Get your new passport and then leave and come back with the L2 visa or file your L2 extension before the I94 expires.
