rao_1 Posted August 16, 2013 Report Posted August 16, 2013 Hi I have a PERM application approved but 1-140 Denied, the process started last year.Even though my attorney tried to get it approved under EB3 category, there was RFE after which it got denied under that category. Attorney is planning on applying a complete new PERM but says she would have to withdraw the old approved PERM application in order to apply a new one as they share some code. I am very confused because i do not want to withdraw the old application as in worst case scenario i could use the approved application to extend my H1 period as my 6 yr period ends next Oct 2014. Please advise Thanks.

rao_1 Posted August 18, 2013 Author Report Posted August 18, 2013 PERM approval by itself does not entitle you to H1 extensions. I thought we could use the approved PERM to re file another I-140 and then apply for H1 extension at the same time.
