H1B max out calculation

Hi,

 

My wife was working in L1B for XYZ company for 2 years. She went back to India. She stayed there for 3 months.

 

After that she came back to USA in L2 visa as dependent. She started working in L2 / EAD.

 

Now she nearly spent 3 years in L2 visa. The current employer will be filing H1B now for next fiscal year.

 

Questions:-

 

1. How long can she stay in L2 visa?

2. If she got H1B visa then how long she can stay in H1B?

3. How the max out will be calculated in case of different visa stay in USA?

1. As long as you are in valid L2 status

 

2. She will be eligible for a total of 4 years in H1 status after getting a H1 petition approved for a start in October, next year.
