B2 (Visitor Visa) to H1 COS filing

I want to do a B2 to H1 COS, my question is, if its possible and how much time does it take?

 

 I will give my background: I came to US a month back on B2 visa and I have my I-94 till December end. I filed for my H1b in 2012 when I was in US on L2 with a sponsor. I got I797 approval notice in 2012 but due to some reason before I can join the company on H1b I moved to India. I came back on B2 and now I want to switch to H1b, the company who filed for my H1 say it is possible but there is risk involved.

 

I got my B1/B2 visa 3-4 years back and during that time I came on B1 for a month to US and then went back to India. Then again came on L2 for a year and went back.

 

Can you help me in understanding the process and the risk involved. And is there a specific time when I can file for COS nad what all document do I need.

You need to get current documentation from the company and leave and return with the H1 visa.
