I am waiting for PERM approval and my current visa (second renewal) is expiring soon. Wondering if current visa expires if I will be eligible for new H1B through another employer. Thanks. shandan Posted August 13, 2013 Report Share Posted August 13, 2013 If you PERM gets approved you can use it to file for a 1 yr extension, or if it has been in pending status for over 365 days then you can use it to file for a 1 yr extension. Other than that, you might be able to use vacation re-capture to get your H1B extended for the number of days you were out of the country (US) in the six year period. Link to comment
omshiv Posted August 13, 2013 Report Share Posted August 13, 2013 You need to be clear on the dates. Are you thru with the 6 yr H1b? If yes, then without the I-140 approval you cannot stay beyond 6 yrs on H1b. Link to comment

pontevecchio Posted August 13, 2013 Report Share Posted August 13, 2013 PERM approval does not give you any H1 extensions beyond 6 years. PERM or I-140 pending 365 days plus give one year extensions and I-140 approved means 3 year extensions are possible. Approved PERM by itself has no connection or relation to H1 extensions beyond the 6 th year. Link to comment
