shabal Posted August 12, 2013 Report Share Posted August 12, 2013 Hi, I am planning to resign soon and go back to my home country. I have a valid h1 visa till Aug 2014. I am planning to stay a week or so to visit few places then leave the country. Is this fine to stay a few days(1 week or so) before i leave? If yes how many days i can stay like that? pontevecchio Posted August 12, 2013 Report Share Posted August 12, 2013 A week or 10 days may not matter. If you want to stay slightly longer file a COS to B2 stating the truth and leave before they decide on the petition. Link to comment

omshiv Posted August 12, 2013 Report Share Posted August 12, 2013 If you are resigning then your H1 becomes null..and you'll be Out of Status. You can convert to B1/B2 and stay as long as the I-94 is valid Link to comment
jairichi Posted August 13, 2013 Report Share Posted August 13, 2013 Officially there is no grace period given to leave US when you resign from your current job on a H1B visa. You have to leave immediately. But, staying for a week would not matter, I believe. Link to comment
