I need your advice in the following matter My girlfriend is a Indian citizen on F1- visa (Student Visa) in San Diego Mesa college. I just found out that priority dates for F2A visa(Spouses and Children of Permanent Residents) for Indians has become current. If I do a court marriage in California with her will I be able to apply for her green card right away What paper work I will need to apply for her green card How long will it take for me to apply for her green card if I avail your services? Can we file I-130 and Adjustment of status together? If not what will the time span on both applications? If we can apply for I-130 and adjustment of status together will she be able to get EAD if the dates retrogress. I also want to know if the following situation can happen. We will apply for her green card and the dates retrogress and she does not get EAD; will that affect her F-1 or I-120 status. Will she be forced to go back to India Thanks a lot for all your help
pontevecchio Posted August 11, 2013 Report Posted August 11, 2013 Give the firm of Murthy a call and SOON. You can file her I-130 and AOS along with EAD/AP Once you are married. Find out that time frame from the relevant department.
