pss12345
Hi, I was on h4 visa for more than a year. I took admission to Masters on h4 and applied for COS to F1. In the mean time My husband has to file for extension for his H1 and as my application was in process so we did not file for H4 extension. Now , I got F1 denial yesterday and my I-94 is expired in June. So what can I do in this situation as I am in the middle of my Masters Degree. Should I file for H4 extension (like nunc pro tunc) or I have to go back and again apply for F1 freshly in order to continue my education. Also, please clarify what is the out of status start date ? My I-94 Expiration date or the day I got Visa denial ?? Please Help ! I am so tensed . Link to comment
pontevecchio
Leave and come back with the H4 visa. Has your current H4 visa also expired? Link to comment
pss12345
Yes , like I mentioned, I was supposed to file H4 extension but I did not do it as my COS was in process. And the H1 extension of my husband is in Initial Review. Link to comment
fulash
What was the reason for denial ? May be you can MTR it. MTR application will reopen your F1 COS case and will take more than 8 months to decision. During that time, you will complete your masters and can file COS back to h4 Check with your lawyer, this may not be the best option for you Link to comment
pontevecchio
Have him convert to PP. Leave and return on the H4 visa. Link to comment
