EB2 Eligibility

I have a bachelors in business administration from an Indian University (10+2+3). I have 17 years of relevant work experience for filing the green card. My attorney says that I am not eligible for EB2 category and my PERM application can be filed only on EB3 category. What are my options?

You did ask him to specify the reason? The EB classification depends on the job requirements and your credentials.

EB category is based on job responsibilities in addition to your credentials. you can have more than 5 years of exp and/or higher degree but if job position only requires EB3, it is classified as is. option is to find a different job position that requires EB2 (and also qualify in that position).

EB2 green card is dependent upon both education and experience

Now you havent mentioned what your current position is and its requirements

For an EB2, you need an advanced degree or baccalaureate degree (4 years) plus 5 years of work experience. In your case you do not have a 4 year degree and so you are not eligible for EB2. Listen to your employer's attorney
