Meanwhile my H1B COS is approved on 16th July and H1 I-94 starts from 1st Oct, 13. 1. Can I withdraw my H4 extension petition on or after 30th Sep,13 to remain on H1 status from 1st October so that I can work. 2. what will be my status between 10th Aug and 1st Oct 3. Since I-539 for H4 extension already applied, Is there any way to request USCIS to extend H4 only till 30th Sep,2013. Please respond ASAP. Link to comment
pontevecchio Posted August 1, 2013 Report Share Posted August 1, 2013 The simplest way is to get the H1 visa in September and come back up to 10 days before the start date. Have you actually informed the Lawyer about your situation? Link to comment

pontevecchio Posted August 1, 2013 Report Share Posted August 1, 2013 No, it will not. Since the H4 extension has not been approved ,the I94 for the H1 is suspect. You have to talk to a Lawyer about it. Link to comment
