Citizenship Eligibility - My Child Born In US

Hi,

 

I am working in US since Jan 2009 on L1 B visa. My son was born last year in US. Based on this I was trying to confirm if there is any eligibility criteria to file for US citizenship.

You son is a US citizen by birth. You could apply for a US passport for him. And, if you have an Indian passport for him you have to return it back to your nearest Indian consulate.

Nope, he can sponsor you once he turns 21

A US citizen child does NOT give you any immigration rights. At least not until the child turns 21. Once the child is 21, the child could sponsor you for a GC.

You will not be eligible for US Citizenship based on this fact if that is what you are asking.
