immilok Posted July 25, 2013 Report Share Posted July 25, 2013 Hi, I got laid off and applied for I 539 from H1B to H4 before my last day of working. Now I have found a new job and the company is going to apply for H1B for me. My I 539 is still pening? Will USCIS adjudicate my both application togather? How does that work? My new company lawyer has ask all my I 539 papers and document along with my H1B documentation. Will it result in RFE ? My company is going to file for premium processing. Link to comment

I am asking this question becuase my lawyer said that it won't be a problem. But I know a friend who had similar case and got REF asking to wait till I 539 is approved. Hopefully you know that Premium Processing implies the Lawyer has the phone number of the Officer deciding your H1. That also implies that your Lawyer can have the COS to H4 cancelled at that time.
