My question is: Can I reapply immediately after moving back to my country (after Jan, 2014), so I am get back into US after Jan, 2015? In other words, do I have to wait for a year to re-apply, or a year to re-enter the US? Thanks! Link to comment

t75 Posted July 19, 2013 Report Share Posted July 19, 2013 A year to reapply. Your petition can be for the 2015 quota if there is availability one year after your return otherwise it will be April 2015 for Oct 2015 start. Link to comment

In your case, if you leave in Jan. 2014, that would mean that an H1 petition could only be FILED in Jan. 2015. If the quota is full by then, it could obviously only be filed in April 2015 for a start date of Oct. 1, 2015. Link to comment
