My situation: My employer filed for my PERM 2 months ago, and my current H1B expires Sept 30, 2013. I have 9 months I can recapture till the end of June 2014. Looking at the current PERM processing trend, I may know something about my case in November 2013. Question: Can I file for regular H1B extension for 9 months end of September, and then later change it to 3 years once I get my PERM & 140 approved? Please advise. Thanks. Link to comment

ineedgc555 Posted July 17, 2013 Author Report Share Posted July 17, 2013 I spoke to my employer regarding this, and he said that it cannot be done. He was saying "since the LCA we apply will be only for 9 months, we cannot later change to 3 years".....is it true? Link to comment
