I-140 approved.Whats next?

Hello,

 

My husband got his I-140 approved on Aug 2012.We did not concurrently apply for I-485.Can Indian Nationals do that? If yes, can we do at this time? Our priority date is Dec 2011.Current is 2008.

One can only file AOS when the PD is current and the person is in the USA in valid H1 status.
