I94 Extension Issue

Hello everyone..

 

My current H1B is stamped until September 30th 2013. My extension has been filed and has been approved from October 1st 2013. This extended I797 has the same I94 number as the one on the I94 form stapled to my passport.

 

I have to travel to India in mid August and will return by the end of August which is one month before my current stamping expires. I was thinking not to get my new H1 stamped yet. I have read a lot and have come to understand that I will not have any problem re-entering the country with my current stamping (am I wrong?). But my question is, will I have to file for an extension of stay after I come back with the new I94 that I will get when I re-enter the US? Or will I still maintain my status without doing anything like that since I already have an extended and valid H1B?

 

I am really short on time and would appreciate any kind of advice.

Your return will be on the basis of the approved H1 petition from October, 2013. Hence your question is not valid.
