Hi,

 

I worked for Company A. They applied PERM in June 2012, got audit in Aug 2012. My 6 years H1 B maxed out in Feb 2013 and hence company A asked me to go back to India. I have resigned Company A in Feb 2013 and changed my status to H4 (dependent on my wife H1). In the meanwhile, Company B applied PERM for me in Nov 2013, got audit in March 2013, audit replied in Apr 2013 and denied in May 2013.  Company B /lawyer applied for reconsideration to CO in June 2013 and CO denied it and sent it to BALCA (may be in July 2013). Here are my questions.

 

1) Is my employer/Lawyer need to anything to continue my case at BALCA?

 

2) Am I going to get H1 B extension after Nov 2013 (it will be more than 365 days by that time)?

 

3) Can Company C apply H1 B extension based on the above appealed BALCA PERM?

 

Can you please shed some light? Thanks a lot for your help. I really

My Perm applied in Sept 2011 and got audit around july 2012 and finally denied on July 2013

my employer applied case with BALCA July 2013

and my current H1 extension valid till Feb 2014

my employer says that we will apply another H1-b extension as my case is pending with BALA is it true?

how long this BALCA process takes?

what would be difference between BALCA process and reconsideration to CO?

I would like to go to India trip as pending my case is pending with BALA?

 

Kindly help me to understand
