File another H-1B petition while old one is pending

Hi,

 

I was working full time for a company and at the last moment they said they could not file H-1. So I filed my H-1B petition through a consultancy. My application got picked up in the lottery but it is still under review. The consultancy filed for H1 as an in house project. My OPT is valid till november 2013. 

 

I have a full time offer now. My question is can this company file for H1 B by using the first H1 receipt number or do I have to wait till my H1 gets approved ? I am worried that my H1 may not be approved with the consultancy.

Why do you think that your H1 will be rejected??
