seemasharma
My current employer A have extended my visa till 2016. I got a new offer from other company B and they transferred my visa on their name. Now I don't want to join new company B and want to continue with current employer A. My questions are- 1 can I continue work with my current employer? 2. New company B can create any legal trouble if I refuse to join them ? 3. New company send me a mail that I have to join them because after transfer and approval, my current visa will not valid..Is it true ? Please suggest me. Link to comment
nomad122
1. Yes you can, as long as your current employer has not revoked your H1 petition. 2. No they cannot. This is willful employment, not forced labor. They cant even force you to bear the cost of the transfer. 3. Again, point 1. If you current employer has not revoked the petition, you can continue to work for him. Link to comment
pontevecchio
1. Yes 2. Read your contract and if in doubt spend a couple hundred dollars on a Labor lawyer to give you an opinion. 3. Not true at all. You can have valid H1 petitions with more than one employer at any time. Link to comment
