kuwtk1 Posted July 5, 2013 Report Share Posted July 5, 2013 Hi, I plan to go to Merida, Mexico in early August for H1B renewal stamping and want to know if an approved I-140 can cause issues with the H1B VISA interview in a third country. Background: I have been a fulltime employee with the same company for over 3 years on H1B and they also started my GC process. My I-140 was approved 1 year back in July 2012. My current H1B stamp expired in March 2013. The DS-160 asks if someone filed an immigrant petition on my behalf, and for me the answer is 'Yes' however I'd like to know if having immigration intent can complicate the matter. Link to comment

Darma Posted July 6, 2013 Report Share Posted July 6, 2013 It's not a problem, I got H1B stampped in Merida July first week, (approved 140 and got H1 on 140), you have to mention in DS 160 about your 140. Thanks Link to comment
