Travel from Canada to USA with a Valid I94 , but no USA Visa

Hello Experts,

 

We are currently in USA with a valid approved H1/L1 Petition and a I94 valid till Dec'2013. The current US Visa in our passports is expired last year. We have a Canadian Visitor Visa valid till 2016.

 

By road, Can we travel to Canada and re-enter USA with no VISA stamping? Is it allowed to enter USA with no Visa but with a valid I94?

 

Could you please share your experts thoughts and suggestions.

A person with no Valid Stamping but just a approved petition (say I-797A with i-94) can enter US with no VISA Stamping ? ? 

 

Say for example:: Miss A has a h1b Petition approved untill 2014, she never went to stamping...Can she travel to canada by road and come back with no h1b visa stamped???

No ..the whole point of a visa is to enter the country at the borders.

 

Your Miss A will need a visa to enter the promised land of APiites.

Yes. If Miss A is in valid H1 status here and has a visa to Canada she can travel to Canada for less than 30 days and return WITHOUT a valid visa for the USA. That is AVR.
