userm
It's just couple of months since i started working here on H1B with small consultancy company. My employer is willing to process my GC ( off course 50-50 expense sharing). I have 5+ years experience in india and i just only bachelor degree. Will i be eligible for EB2 category? GC process has something to do with your reputation/size of the company...? My questions are: It is advisable to go for GC processing now.? will i fall in EB2..? Assume i start in couple of days, how many days i need to stick to this employer based on current situation? I am new here and my questions might be dumb as well. don't mind Link to comment
omshiv
You dont qualify for EB2. GC processing does not matter much about the reputation/size of the company..it does though to some extent. If your employer is willing, then they can sponsor your GC now. You need not stick with them..as GC is for future employment. Link to comment
pontevecchio
Talk to a Lawyer. If it is Masters or Bachelors plus five as minimal requirements you may be EB2. Link to comment
t75
The 50/50 model is not appropriate. You are permitted to pay certain fees and he is required to pay others. Your company must be able to prove that it will be able to pay you at the time of the GC. Link to comment
gcode
you can get your GC processing started. for EB2 its Masters or Bachelors + 5yrs exprience. Also employment based GC if filed based on future employment, i near future if you want to swtich employer you have to start the GC process with your new employer all over again and if there is no fraud invovlved in GC processing from you previous employer you can retain you priority date provided that you have an approved140 from previous employer.
