Hi, My husband came to US on H1 Visa 13 years ago. My son aged 15 and I accompanied him on H4 visa. Our son converted to F1 Visa once he joined Undergraduate Program and he continues to be in that status today. He has a PhD in a STEM degree. After PhD he joined a non STEM Masters program for further enhancing his STEM degree. He does not have any further OPT available. He is searching for a job in a Non-Profit organization and is in the last 60 days grace period before he has to leave the country.

My husband and I are Citizens now.

1. As we brought him as a 15 year old, does he have any recourse to continue to stay here?

2. Can we, as citizens file for extension of his stay in the US?

3. Can he file for his own H1 while he is searching for a job in a Non-Profit?

I will be grateful if an attorney can reply to this question.

NO, NO and NO.

He needs to return to his home country. You may file for him as the child of a USC and should have done so as soon as you obtained your citizenship..

H1B visas require sponsorship. As an immigrant, you should know this.

I find it difficult to understand how he has a STEM PhD and is unemployed.  It proves that they are lying about opportunities for advanced degree holders.
