My GC is in process (awaiting for the date to get current) and my employer is renewing my H1B and I have to take an international trip, so I have to get the visa stamped in India. Are there any risks in getting my visa stamped since I have finished my 6 years of H1-B visa and I will be renewing my H1B visa based on my GC application in process. The concern I have is that the main reasons for the consulate to refuse stamping is saying that you are potential immigrant and now it will be quite evident as my GC is already in process. pontevecchio Posted May 29, 2013 Report Share Posted May 29, 2013 Your post makes no sense since H1 status ALLOWS for Immigrant intent. It is puzzling that you are still not aware of this fact after 6 years in H1 status. There are many reasons why a H1 visa stamping can be delayed. But Immigrant intent is not one of them. VO asked me did you apply for perm resident? I said yes, that was the last question she asked me. So, do not worry, this is not at all a concern, my suggestion is to go to Canada/ Jamaica to get it done rather in India (success ratio is comparatively good in either Canada/Jamaica) Link to comment
