varindert Posted May 22, 2013 Report Posted May 22, 2013 I am in very strange situation: I traveled to India in November 2012, went for H1-B stamping, consulate asked me for an additional document. In couple of days I submitted the document to US consulate, waited for couple of weeks, no response. In mean time I had to come back on AP/EAD for a family emergency in US. In Jan I got an email from US consulate asking me to submit my passport. I told them I am back in US on EAD/AP. They replied back when ever I travel to India I need to submit my passport. But I am still not sure my stamping is approved or rejected. US Consulate still has my original I-797, which is expiring in October 2013. My Question can I apply for H1-B extension? I know for a fact even though I entered on AP my current status is H1-B (because my H1-B is still valid). Anyone been in this situation before? Thanks. VT
