Hello,

I have few questions regarding my situation and how to proceed from here.

A short background:

  1. I have arrived in the US in 2008 for my Masters under F1 visa.
  2. Finished my Masters in the Dec 2010.
  3. Started working as a full time employee at a University which is Non Profit from February 2011 under my OPT.
  4. I obtained my H1B visa through the university in November 2011 which is Cap Exempt as the university is a Non Profit organization.
  5. I started my PhD at a different university this is close to where I live and I take part time classes while working full time at the first university.
  6. The university where I work, applied for my Green Card under EB3 and my I140 is approved. My priority date is in March 2012.
  7. I would like to work at the same university till I finish my PhD and would like to find jobs at the same or a different university or in the industry.

My questions are:

  1. What is the best way to proceed, to get a Green Card if I choose to go to the Industry.
  2. Is it hard to find employers who would wait for my new H1B (transfer) as my current H1B is cap exempt?

I will really appreciate your response.

Thank you

Many people do coursework part time. However, they generally are required to spend at least 1 year in full time residence for research.
