Received I-797 B Approved till Dec 2014 Without i-94.Have Valid H1 Stamping on passport till Jan -2014. Do i need to go to Home Country for Stamping?

Hi all,

Was Working with Company-A and then changed Employment to Company-B recently. I have Valid H1 Visa Stamping through Company-A till Jan 2014. I got I-797B Approved till Jan 2015 when applied for H1 Transfer without i-94.

1) Do i need to go to Home Country for Visa Stamping again ?

2) My Employer Company-B(working with new company for the past 3 months) suggested that i don't have to go for Visa Stamping as i have valid visa till Jan 2014. He wanted me to go to home country and come back after 2-3 days and i will be given new I-94.

Please advice me.. Thanks in advance for all your advice's..

Since you have valid visa to re enter into US, all you need is a new I94. So your employer is correct.

But wait for more replies.

Ordinarily your existing visa should be adequate. Since we do not know your circumstances and since you are in the firing line get a Lawyer on your side to guide you.
