rajeev555
I am applying for citizenship for my mom. She is a GC holder right now for more than 5 yrs. She is in the USA right now. My question is, during her Green card she stayed in India only once for more than 6 months due to medical problem. When she came to the US, the immigration officer never asked her anything why she stayed more than 6 months. Now i am applying for her citizenship. Will it cause any problem if she stayed in India for more than 6 months when applying for her citizenship. Thanks Link to comment
JoeF
It depends. She may have broken the continuous residency requirement. See the naturalization worksheet on the USCIS website. Link to comment
t75
OP, Your posting makes it sound like she is not truly a LPR. And, YOU cannot apply for her citizenship; she has to do so herself. Link to comment
bhamurs
She can file the Application (N-400). Along with the application she has to support documents (Medical Records) substantiating her over-stay in India for more than six months. 02. To prove for continuous Residency, she has the produce/submit the records like Bank statement, Lease agreement, Tax Stubs etc.,. Basically, she has to prove that she has not abandoned US Residency. Good Luck Link to comment
pontevecchio
You can certainly file if you are prepared to lose the money. I suspect as long as her stay outside was less than an year she will be asked why and she can explain. Get medical letters necessary. Link to comment
