H1B layoff, have EAD

Hi,

I am on H1B (beyond 8th year). I also have an EAD/AP for the next two years, but i am not using it now. My i485 petition has been pending for more than 1 year now (ie 180 days has crossed long time ago, so i can invoke AC21 to change jobs).

I see my company can do some layoffs.

• Given that i am currently on H1B, what will be my status after layoff ? Automatically change to EAD/AP ?
  
  • How do i maintain valid status ?
    

  [*]Is there any time available for me to look for jobs ?

No automatic change to any status. What will happen is that the pending AOS lets you stay legally and the EAD lets you work. You have all the time in the world to look for a similar job . They may or may not ask for proof of an EVL at any time. That would possibly be rare.
